California Wrongful Death Lawyers

Losing someone you love is one of the most difficult things you will ever go through. It is hard enough when families have time to prepare for the loss, but when a death is caused by the negligent actions of another person and happens suddenly and unexpectedly, it is even harder to come to terms with the situation. As you deal with your grief, you may also be facing mounting bills pertaining to the loss. You may also no longer have the income of the deceased on which you once depended for survival.

When someone else was responsible for your loved one’s death, you can hold them accountable for paying financial compensation for your losses. Our California wrongful death lawyers at Burris, Nisenbaum, Curry & Lacy, will give you the best chance of success with your claim.

California law defines wrongful death as a death that is caused by the negligent, reckless, or careless acts of another person. Wrongful deaths can occur in any number of different types of accidents, and they are all preventable. The most common types of accidents that cause wrongful death include:

  • Motor vehicle accidents, including collisions involving cars, trucks, and motorcycles
  • Pedestrian accidents
  • Bicycle accidents
  • Premises liability accidents, including slip and falls
  • Swimming pool and drowning accidents
  • Medical negligence
  • Nursing home neglect and abuse
  • Criminal or malicious acts
  • Police shootings and police brutality

If you have lost a loved one due to a wrongful death, it is important to speak to a lawyer who can advise on how to file a claim.

Only certain individuals have the legal right to file a wrongful death claim under California law. These individuals include the surviving spouse or domestic partner of the deceased and surviving children. If the deceased did not have a spouse, domestic partner, or children, the parents and siblings of the decedent have a right to file a claim.

Through a successful wrongful death claim, relatives of the deceased can claim monetary damages for the losses they incurred as a result of the death. Damages loved ones can claim include funeral and burial expenses, the lost income of the deceased they depended on, and the loss of support and companionship provided by the deceased.

It is possible to claim damages for the losses the deceased incurred prior to their death, but you must file a survival action to claim this type of compensation. Any damages awarded in a survival action do not go to surviving loved ones, but the deceased’s estate. A survival action can be filed in conjunction with a wrongful death claim.
