Racial discrimination is not only illegal, but it is also hurtful, and it can result in real financial loss for the victim. You may lose out on promotions, bonuses, and other compensation. In the most extreme cases, it can even cost you your job.

If you have been treated unfairly, you have the right to file a lawsuit against your employer to recover monetary compensation for your losses. Our California racial discrimination lawyers at Burris, Nisenbaum, Curry & Lacy can help you claim the full damages to which you are entitled.

Some employees think their employer has discriminated against them just because they did not treat the worker nicely. This in itself does not provide valid grounds to file a lawsuit. Employers who berate their employees or verbally abuse them are not breaking racial discrimination laws if the behavior is not discriminatory.

For example, the owner of a company may treat all of their employees rudely. If the owner acts the same toward all employees and does not target workers of a certain race, there are no grounds for a racial discrimination lawsuit. To file a lawsuit, you must prove that your employer treated you differently and unfairly and that it was based on discrimination. If the owner of a company was only rude to employees of a certain race, that could provide grounds for a claim.

Both the Title VII of the Civil Rights Act of 1964 and state law prohibit racial discrimination in the workplace. Under these laws, employers must treat all employees fairly and cannot consider race when making decisions on hiring, firing, promoting, or demoting workers. Employers are also prohibited from retaliating against employees who oppose discriminatory practices or file a racial discrimination complaint.

Experiencing racial discrimination is very distressing. You may consider quitting your job and simply finding other work. You may just want to forget the whole ordeal. Unfortunately, if you choose to ignore the situation, it will not just go away and you may find that you continue to experience loss, both emotional and financial. By filing a lawsuit against your employer, you can recover damages that can help you to move on from the experience. The most common types of compensation available in racial discrimination cases include:

  • Lost wages
  • Dental and medical insurance
  • Lost bonuses, vacation pay, and sick pay
  • Interest accrued on economic damages
  • Emotional distress
  • Legal fees
