KNOW YOUR RIGHTS: Protecting Yourself from ICE/DHS

When federal agents arrive at your home, workplace, or stop you on the street, you have constitutional protections regardless of your immigration status.

  • You Have the Right to Remain Silent: You do not have to answer questions about where you were born, how you entered the country, or your immigration status. You can simply say: “I am exercising my right to remain silent.”

  • Do Not Sign Anything: ICE agents may pressure you to sign documents (like a “voluntary departure” form) that give up your right to a hearing. Never sign a document without your lawyer present.

  • Demand to See a Judicial Warrant: ICE cannot enter your home without a warrant signed by a judge. An administrative warrant (signed by an ICE official) does not give them the legal right to enter your private residence without your consent.

  • The Right to Record: You have a First Amendment right to record ICE/DHS interactions in public spaces, provided you do not physically interfere with their operations.
